Terms of Service

1. Acceptance of Terms

By creating an account or using Dito, you agree to these Terms and our Privacy Policy. You represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have reviewed these Terms with a parent or guardian and they have agreed to these Terms on your behalf.

2. Description of Service

Dito is a social scheduling application that helps you coordinate meetups with friends by:

• Connecting you with friends through friend requests.
• Discovering friends through phone number matching from your contacts.
• Accessing your calendar events with your permission and identifying mutual free time slots by sharing only busy/free availability with friends.
• Suggesting nearby venues using location-based search.
• Suggesting meetup times and locations.
• Sending notifications about meetup invitations and confirmations.
• Syncing confirmed meetups to your calendar.

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice.

3. User Accounts

3.1 Account Creation

To use Dito, you must create an account by providing accurate and complete information, including your name, email address, and a secure password. You agree to:

• Provide truthful and accurate information.
• Maintain the security of your password.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activities under your account.

3.2 Account Termination

You may delete your account at any time through the app's Settings > Delete Account screen, or by emailing ashleyredhead5@proton.me. Upon deletion, your account and associated data will be removed within 30 days as described in our Privacy Policy. We reserve the right to suspend or terminate your account if you violate these Terms.

4. User Conduct

When using Dito, you agree not to:

• Violate any applicable laws or regulations.
• Impersonate any person or entity.
• Harass, threaten, or harm other users.
• Upload or transmit viruses, malware, or other malicious code.
• Attempt to gain unauthorized access to the App or other users' accounts.
• Use automated systems (bots, scrapers) to access the App.
• Reverse engineer, decompile, or disassemble any part of the App.
• Post or share content that is illegal, obscene, defamatory, or infringes on intellectual property rights.
• Spam other users with unwanted friend requests or messages.
• Use the App for any commercial purpose without our written permission.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you submit to Dito, including profile pictures, messages, and meetup details ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your User Content solely to provide and improve the App's services.

You represent and warrant that:

• You own or have the necessary rights to submit User Content.
• Your User Content does not violate any third-party rights or applicable laws.
• Your User Content does not contain harmful, offensive, or inappropriate material.

5.2 Our Intellectual Property

The App, including its design, features, graphics, code, and all intellectual property rights, is owned by Redhead Studio (a trade name of Ashley Redhead) and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

6. Content Moderation

We reserve the right (but are not obligated) to:

• Monitor User Content for violations of these Terms.
• Remove or refuse to display User Content that violates these Terms or applicable laws.
• Suspend or terminate accounts that repeatedly violate these Terms.
• Report illegal activity to law enforcement authorities.

While we are currently in beta testing and content moderation features are limited, we take user safety seriously and will respond to reports of inappropriate behavior. To report a concern, email ashleyredhead5@proton.me.

7. Third-Party Services

Dito integrates with third-party services to provide app functionality. Your use of these services is subject to their respective terms and privacy policies:

• Google Calendar API – for calendar access and availability sharing
• Google Cloud Platform – for backend infrastructure
• Google Cloud Storage – for profile picture storage (us-central1)
• Google Places API – for venue search and location-based suggestions
• Expo Push Notifications – for app notifications
• Gmail (Google) – for sending password reset emails via SMTP

We are not responsible for the practices or content of third-party services. You use them at your own risk.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Dito, you consent to our Privacy Policy.

9. Beta Testing and Service Availability

Dito is currently in beta testing. This means:

• The App may contain bugs, errors, or incomplete features.
• Service may be interrupted or unavailable at times.
• Features may change or be removed without notice.
• Data loss may occur (though we take reasonable precautions to prevent it).

We provide the App on an "as is" and "as available" basis during beta testing. We appreciate your feedback and patience as we improve Dito.

10. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DITO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Warranties that the App will be uninterrupted, secure, or error-free.
• Warranties regarding the accuracy or reliability of any information obtained through the App.

You use Dito at your own risk. We do not guarantee that the App will meet your requirements or that calendar integrations will always function correctly.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REDHEAD STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the App.
• Any unauthorized access to or alteration of your data.
• Statements or conduct of any third party on the App.
• Missed meetups or scheduling errors.
• Any other matter relating to the App.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Redhead Studio from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App.
• Your violation of these Terms.
• Your User Content.
• Your violation of any rights of another person or entity.

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts and the United States, without regard to conflict of law principles.

13.2 Dispute Resolution

If you have a dispute with us, please first contact us at ashleyredhead5@proton.me to attempt to resolve it informally. If we cannot resolve the dispute informally, any legal action must be brought in the state or federal courts located in Massachusetts, and you consent to the exclusive jurisdiction of those courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of these Terms and notify you through the App or by email if the changes are material. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Redhead Studio regarding the App and supersede any prior agreements.
